After the CLAT 2018 fiasco, under the directions of the Supreme Court, a Committee was constituted to look into the matter of improper conduct of CLAT-2018 and to take remedial measures for future exams. The Committee submitted its report to the Supreme Court, which brought out various lacunae in the way the CLAT has been conducted over the years and suggested some changes.

An interesting aspect mentioned in the report is that the income from CLAT 2018 was approximately Rs. 25.7 Crores, while the expenses for conducting the exam were around Rs. 2.6 Crores.

A further amount of around Rs.1.06 Crores was spent for ‘Legal expenses’ related to the exam – probably for addressing the PILs filed across various High Courts; which were later consolidated and taken over by the Supreme Court.

As per the CLAT model, the organizing NLU keeps 50% of the final profits from the exam and the remaining 50% is distributed among the other participating NLUs.

NUALS Kochi, which conducted the CLAT 2018 retained a little over Rs.9.5 Crores as profit from the exam.  Over Rs. 12.3 Crores was earmarked as the profit to be shared by the other participating  NLUs.

Apparently, NUALS Kochi clarified that the accrual expenses were actually  approximately Rs. 5 Crores, the breakup for this amount is not included in the report.

So, the profit margin for conducting the CLAT 2018 exam was around 90% This represents a mark-up of around 885%

In simpler words, this situation would be as if a product costing Rs. 100 is sold for Rs. 985.

As per the report, the charges to be paid to the service provider for the conduct of the exam were Rs. 210 per candidate. Whereas the exam fees collected were Rs. 4000 from General candidates and Rs. 3500 from reserved category candidates.

Among others, the Committee has recommended that “The Fee charged for the examination is not in concordance with the expenditure and grossly high given the expenditure incurred. Even if it is in the policy of the NLUs to earn profit out of the examination (however undesirable), earning 90% profit is egregious. Given the current expenditure and to cater to additional measures that may be taken for fair conduct of examination (including phone signal jammer, etc.) fees of Rs. 1500 is reasonable. This amount will cover the direct and indirect cost of conducting examination and still leave some spare for additional procedure/activities for candidates.”

As we wait for the CLAT PG 2019 announcement to be released, it would be interesting to see if this feedback is incorporated and the fee is reduced to a more affordable level.

Update : The CLAT exam (CLAT PG and CLAT UG) is now conducted by the CLAT Consortium.
