What is Project development – Oil and gas law practice?

India is the third-largest energy consumer in the world. Oil and gas accounts for over 40 per cent of the country’s total energy consumption. With a growing demand for energy; we are seeing an increasing number of projects being kicked off in the Oil and Gas sector.

Projects in the Oil & Gas sector can be classified into three sectors:

  • Upstream projects – which are essentially exploration, extraction and production related projects.
  • Midstream projects – which comprise of transport, storage and supply of the products from the upstream phase.
  • Downstream projects – consist of refining and sale of the end use products; such as petrol, diesel, fuel oil, gas and other distillates or residuals.

Oil and Gas is a highly regulated industry, with the Ministry of Petroleum & Natural Gas overseeing the sector as a whole in India.

In addition, Law firms engaged in Project development – Oil and gas practice need to work with regulatory bodies such as:

  • Directorate General of Hydrocarbons (DGH)
  • Oil Industry Safety Directorate (OISD)
  • Directorate General of Mines Safety (DGMS)
  • Petroleum and Natural Gas Regulatory Board (PNGRB)

The regulatory frameworks that directly influence this practice area include:

  • Oil Mines Regulations, 2017
  • Petroleum and Natural Gas (Safety in Offshore Operations) Rules, 2008
  • The Mines Act, 1952
  • The Oilfields (Regulation and Development) Act, 1948,
  • The Petroleum & Natural Gas Rules, 1959,
  • The Petroleum Act, 1934,
  • The Petroleum pipelines (Acquisition of Right of User in the land) Act, 1962
  • The Petroleum Rules, 1974,
  • FDI regime
  • The new exploration licensing policy (NELP)
  • The hydrocarbon exploration and licensing policy (HELP)

In addition to the above, Law firms also need to be conversant with various treaties, bilateral agreements and double taxation avoidance agreements that cover Oil and Gas projects in India.
