What is Project development – Energy law practice?
As the Indian economy grows year on year, the need for energy also increases exponentially. This opens up opportunities for a large number of Indian and international players to enter the energy sector in the country.
Be it traditional coal or gas fired thermal power plants, solar or wind energy farms, hydroelectric projects, co-generation projects, barge-based generation plants or even nuclear power projects – they all require the support and services of specialised legal firms.
In general, Project development in the Energy sector sees four categories of stakeholders:
- Developers – who put together the entire project.
- Financiers – such as banks, international development agencies, foreign export credit agencies who provide the funding
- Contractors and Service providers – who undertake the actual construction of the project
- Input providers and suppliers – who provide the primary inputs required for the establishment and operation of the project e.g., Oil & Gas companies, land owners
- Buyers – such as manufacturing units, energy supply and distribution companies; which are the primary consumers of the output
- Government – which controls the regulatory framework and may provide financial incentives that affect the commercial viability of the energy project
The activities in this project area include:
- the initial project planning and due diligence,
- evaluating commercial viability,
- assessing political, regulatory and financial risks,
- negotiation and agreements with the various stakeholders
- regulatory, environmental and other approvals
- establishment of the appropriate corporate structures
- advising through the development and construction phases
- ongoing compliance and monitoring frameworks
Projects in this area typically have long gestation periods and an extended lifecycle – allowing the law firm to provide support and services over several decades.
