What is Joint Venture law practice?
A Joint Venture is a contractual arrangement under which two or more companies undertake a business activity that is subject to joint control. A Joint venture can be in the nature of a contractual or a structural arrangement or both.Joint ventures can be broadly classified into the following categories:
- Company or equity joint venture
- Contractual joint venture
- Partnership joint venture
- Limited liability partnership joint venture
Joint ventures are governed by the legal frameworks applicable on the form and sector of the business:
- Companies Act 2013 (Companies Act) in case of a company joint venture
- Limited Liability Partnership Act 2008 in the case of an LLP
- The Indian Contract Act 1872 in the case of contractual joint ventures
- The Indian Partnership Act 1932 in the case of partnership joint ventures
In addition, the joint venture will have to comply with other laws such as:
