What is Fintech, Blockchain and Cryptos law practice?
In the recent years, India has been at the fore-front of the global fintech revolution. The Government’s push for increasing digital payments has seen the roll out of technologies like the Unified Payments Interface (UPI). India has also seen an explosion of wallets, payment apps and other digital payment tools.
Blockchain is another emerging new technology that is being used to track and secure all forms of essential documents and records such as land records, invoices, personal records, educational records.
Crypto currencies are decentralized digital currencies based on the block chain technology, which are seeing increasing interest and acceptance across the world – especially for online transactions. Currencies like Bitcoin, Ethereum and Ripple have seen a lot of speculatory interest from Indian investors.
After the initial regulatory resistance, the Government of India is working towards building a regulatory framework around the Crypto currencies. While non-fiat Cryptocurrency may not become legal tender in India anytime soon, the Government is exploring the underlying blockchain technologies to usher in the digital economy.
Companies are looking at leveraging FinTech, Blockchain and Crypto currency technologies; and need law firms to track the ever changing legal and regulatory frameworks and advise them on various aspects such as:
- Entry strategies, including setting up of financial services and FinTech, Blockchain or Crypto currency-based businesses in India and securing regulatory licenses, approvals
- Financial product feasibility assessments, ongoing compliances and regulatory risk assessments
- Strategic M&A, JVs, mergers, referral and service arrangements
- Representing clients before Indian regulators such as RBI, SEBI, Ministry of Finance, Tribunals and Courts
- Advising on regulatory aspects of Payment services, pre-paid payment instruments, payment gateways and aggregators, electronic and mobile money services and traditional financial services done digitally
- Technology transfer and licensing, development and procurement, development and licensing
- Intellectual property creation, exploitation and protection
- Data protection, cyber-security and information security
- Making regulatory representations and assisting on policy formulation
